It's LHT... General feature of LHT is that they stretch a ton...
No experience with N&F LHT though

I would keep them..

This fit is poor at best.
The block and thighs don't do your body ANY justice. You should really re-think those jeans.

I don't care how much the jeans give. The waist band block and thigh don't look good. The fact that your jeans are all twisted up doesn't help either.

Is there gapping in the waist band or does it lie flat against your back?

there is some gap if worn wear i am wearing them in the pictures. if i wear them a bit lower, the waistline is snug, and that seems to solve other issues as well re: bulging in crotch area, and gives the thighs a little room to breath. I think i am wearing the jeans a bit high in these pics given their low rise. Also doesn't help that I had just gotten back from the gym, where I had done some squats.
