going forward, nothing you can do except contact the buyer and try and arrange a revision.

going backward, escalate the request to a claim to close out in your favor and they cannot leave feedback.
Unfortunately it wasn't opened as a case, it was initiated as a return, so there was no way for me to escalate it. What else is unfortunate is that if he opened a case, I would have won and he wouldn't have been able to leave feedback. But now, since I did things the appropriate eBay way, I have neutral feedback and a defect.

Return requests can be escalated to a case (the step in and ask ebay to help) button - usually on the 4th business day after the case is open, or if its a clear case of buyers remorse, at any time. You had a ****** ebay rep who didnt offer that to you.

eBay will likely not take down a listing that is using images or a description from another listing that has already ended. I've reported it a couple times when people flipped things they bought from me, and nothing happened. Apparently both listings have to be active.

Truth, but hopefully MG can use this as evidence that this person isn't just acting in bad faith in her transaction but is actively using eBay in a fraudulent manner. Supposedly they care about being a place where that's not supposed to happen. Also, WE ARE GOING TO RUIN THIS PERSON.

According to eBay, people have to ask for permission in order to use your pictures and/or description. It boggles my mind that TheNeedMachine brought this up to eBay and they did nothing. Perhaps they need more examples..... Either way, I'm preparing for battle.

I just looked up in eBay's help section "Another member is using my pictures or description." The first answer was...

"You can't use another member's pictures or descriptions without their permission. If another member is using your images or description, let us know.

Read our images and text policy for more information.

Tip: You can watermark your pictures with your username details."

So from there, I clicked on the "Images and Text Policy".... See for yourselves.... http://pages.ebay.com/help/policies/image-text.html
People use my stuff all the time, I run across it by accident or another SF member points it out to me. All my pics are watermarked, but that doesn't stop them. I always report it, but nothing is ever done before the auctions end.

If I buy it from him, will you just send it to me?

This would be interesting. Gonna wait for whoever to buy and pay for it, then use that money to pay Spoo for it, Spoo will ship it to him and they'll ship it to you. OR they'll message Spoo saying "Can you send it to this address instead?" and have Spoo ship it to the third party (Wes). They'll get the money and never have to do any work... Won't even see the shirt. Spoo will be doing all the work for this person.

The worst of it all? This guy is an SF member and he's following @BrianPore. I got nothing against @BrianPore either; I follow him and many other SF members as well. He told me he was a member on here. His username on eBay is reenilf. If anybody knows who this is, please let me know. I just want to know why he's trying to scam me out of a perfect suit AND the money..... And he'll probably take my listing and put it up under his name. Sigh. Any help is appreciated!

I'm staying out of this one, but the one thing I did sell to him....he never paid for and an unpaid item case was open and closed agaisnt him. I never thought to check if he had it listed for sale over that week.
