Shoe fit Question

I recently bought a pair of john varvatos oxfords off of ebay (grapevinehill) and when they came today, they were just a touch too big (my ankle isn't completely supported as I take steps). My step father said all I would have to do is by a tongue pad (not sure about the name) and the problem would be solved. If you were confronted with this scenario would you buy something and make the shoes work or would you send them back?
