Mr. Dan Slater, ebay id baduba69 was the high bidder on a pair of John Lobb's that I had on ebay. After getting the second invoice he emails me this nugget:

"I sent you an email days ago asking for your return policy before I sent payment. I want the shoes but due to the price I need to make sure they are returnable if they don't fit!"

My response

"Dan, you are asking me a question that should have been asked before you placed your bid or for the five days the auction ran, not after you won. The answer is that I will not accept a return due to sizing as the size, last and all relevant information was posted, including that there was no return policy. I will assume you are not paying so I will go through ebay for remediation."

I admit I was a little terse but I don't like taking returns from ebay buyers, especially on shoes as once they pay you through paypal they can josepidal the shoes, return them and then you are on the hook for the refund and if you complain about the condition of the shoes and refuse the refund, then they get paypal to screw you.

Anyway, his response was:
"**** YOU!!!! Look at my history, I don't typically make mistakes. Unfortunately I made a mistake and this time it happened to be with a real ASS HOLE like YOU. Do what you got to do. I will slay you if I get any negative feedback whatsoever. "

Obviously a classy guy. Of course I'm trembling from the threat of getting my first negative feedback on almost 400 transactions

My response:
"asshole is one word. You can go ahead now and leave whatever negative feedback you'd like. Thanks for the email as it will probably get my claim through ebay a lot faster. Have a good weekend!"

This is obviously only my problem but I thought I'd post it since I see that he has purchased from Andrew, Ben at ehaberdasher and others that visit the forum. Don't get on the wrong side of Mr. Slater, or he will slay you!!!!!!!

ed, im going to immediately place this handle on my block list.
obviously he wanted something to attack on so he can weasle out of this one.

i would go as far as report that email to ebay as well perhaps, not that they would do anything about it ,but would make me feel that i didnt do anything about it.

immediately i would report unpaid item and get final sale fee back and do second chance offer to the next guy.

slay you.? what an idiot.

Would being "slayed" require the use of the ubiquitous "slayer" smiley?

Anyway, Ed, I understand your frustration and think you did the right thing. You've been selling long enough you can cut through the 10 different back and forths that would come to the same result as you had. So, luckily you didn't waste more of your time with this guy.

I don't sell nearly as often as you, but even in my relatively brief experience I've found that people just don't read, or even when they do they still try to manipulate things to their whim and then try to hold you responsible for it. Just recently, I had one international buyer ask me the price to ship internationally via Express mail for a heavy pair of shoes. I quoted him the actual price five days before the auction ended and never heard back from him. He bid in the last minute, won the auction, THEN replied to my email saying, "Wow, that sounds too expensive to ship!" and we went back and forth over the shipping...

I think perhaps some buyers think they are crafty and can just bully their way through AFTER the auction is over. So, good for you to stand up for yourself.

[Non-] Buyer is a jerk but you did one bad thing as well.

For you to write "I assume you are not paying..," was an error. Assume nothing.

I always act as if the transaction can be completed satisfactorily until I am certain it can't. My terms demand payment within 7 days. I leave neg feedback after the end of 14 days, but only after I have exhausted every other option.

edmorel - over the last six years, I have purchased and sold hundreds of things on ebay. I have learned many lessons. First of all, there are many idiots on ebay. But, the most important lesson I have learned is that for long term success on ebay, you have to take the high road. What I suggest you do is apologize (even if you don't feel you need to offer an apology) to the buyer and offer and ask him to mutually agree to cancel the transaction. You might lose some of your listing fees but it will be in the long run a much better solution.

Don, you are absolutely correct and that is a "high road" type of thing to do, which is what I would normally do, but once I get cursed at I become more of a "low road" type of person.

Ed,
You are 100% right but I suggest that you take "The wise road".

Have either of you left Feedback? I'm guessing that the answer is No, because otherwise this conversation would not be necessary. If you were to leave a well deserved negative feedback for him (or a non-paying bidder strike), I'm sure he would leave a retaliatory Negative for you.

You can Email him and just agree to not complete the transaction and report this to Ebay and you won'y have to pay the Ebay transaction fees. Then you can resell the shoes.

Now, sure you are 100% right, and this seems to be giving in to extortion and/or threats! But that's the terrible irony of the Ebay system. It's better to give in than get in a mud slinging match and have a Negative Feedback.

I've always felt that any seller that has a high Feedback number, let's say over 1000 distinct sales, and has a 100% Positive Feedback rating has likely eaten crow and taken the "wise road" occasionally!

Given enough sales, there will always be a real asshole! Someone that will lie, cheat and try to steal. But that's part on the Ebay world. Even if a seller is A-1 like yourself or Ben or Jonathon, there will be that liar that will try to cheat. I think that when you see a high Feedback # with a 100% positive rating, there are occasions when the seller had to eat crow and give a return or not complete a transaction, even though the seller was 100% right!. And this is not reflected in the Feedback.

Let us know what you do. And BTW, you didn't say. What does the verb josepidal mean?

This is one of the things I really don't get about ebay. There is this kind of mutually assured destruction thing going on for each transaction, one side of a transaction can be a total fuckup but it will rarely get reflected in their score because no one is honest and everyone is vengeful.

With the lack of SELLER protection, I wouldn't have gone through with the transaction as well. There's nothing really stopping the buyer from making a claim or doing a charge back after he realizes they don't fit. At best, you get back your shoes in questionable condition.
