ebay annoyance; advice sought

I once won a pair of shoes for ridiculously cheap, and the seller emailed me to tell me that they were "damaged in shipping", so he just gave me a full refund. How thoughtful of him...

He leaves negative feedback, he gets negative feedback. At least pursuing it makes taking the negative feedback a little bit more palatable. At least it was for something.

I would do that assuming positive feedback had already been left for me. If he left me negative feedback, I definitely would pursue it.

The seller is wrong, having said that he can refund your money and take his chances with ebay if he wants. Why not split the difference with him if you really want the scarf...maybe not the right thing to do since he should have known better, but if you leave him negative feedback get ready for him to do the same, and that is not worth it IMO.
