It’s refreshing to see that our judiciary doesn’t consider itself to be above a little trolling now and then

What a sell out.

“The Court agrees with Quintana that tacos and burritos are Mexican style-sandwiches, and the original written agreement does not restrict potential restaurants to only American cuisine-styled sandwiches,” Bobay’s decision said.

To be fair...**** the planning commission that was gonna allow him to operate the business if he slapped ingredients between slices of bread like a white boy, but not if he folds them up in a tortilla like a brown person.

Judge seems to have made the right call here.

"“The original written commitment would also permit a restaurant that serves made-to-order Greek gyros, Indian naan wraps, or Vietnamese banh mi if these restaurants complied with the other enumerated conditions,” the judge ruled."

Subway is awesome and you should all eat there regularly.

If you're going to shill for your wife's portfolio, at least shill for a great brand like Culver's.

I didn't pay attention to the case. This was the city planning department rule? The one about 15 years ago was a mall contract that Qdoba sued over because another company had got the mall to agree to not allow any other sandwich shops.

That comes off as reasonable to me though.

In the context of competitive markets (assuming they allowed other food like say…panda express), a burrito place is distinct from a sandwich shop.

In the context of zoning/code on what type of food service is allowed to operate, I’d say a chipotle-style taco or burrito reasonably falls in the same category as a subway or Jersey Mike’s (although I recognize that cold cuts are not the same as chicken/steak that needs to be cooked which could pose an issue). The rule there is clearly written to deal with the health & safety and business type issues and shouldn’t really care whether your carb is a slice of bread or a tortilla. It was probably dumb to ever write a rule that specified sandwiches, but the judge seems to be making a reasonable call based on the spirit of the law.

Crazy ass storm blew through Houston around 6:15pm local time with winds strong enough to be a cat 1 hurricane. My neighborhood looks like a war zone now with huge parts of Houston with no power. Pictures from my street and neighbor’s backyard.

Tacos outdate all those other foods. They are the ones that should be labeled "AmeriKKKan style tacos."

would you ever put rice in a sandwich ? or potatoes ? if I were arguing this for the taco place i'd appeal to fillings .

I'd enter into evidence the most delicious burrito together from non-sandwich friendly ingredients and then i'd put the same ingredients together as a stupid sandwich boo . and then the judge who is literally taste-testing for facts would have to stroke his muttonchops and agree . pretty sure that's how law works
