To be fair...**** the planning commission that was gonna allow him to operate the business if he slapped ingredients between slices of bread like a white boy, but not if he folds them up in a tortilla like a brown person.
Judge seems to have made the right call here.

How is that different from a normal day?
That comes off as reasonable to me though.
In the context of competitive markets (assuming they allowed other food like say…panda express), a burrito place is distinct from a sandwich shop
In the context of zoning/code on what type of food service is allowed to operate, I’d say a chipotle-style taco or burrito reasonably falls in the same category as a subway or Jersey Mike’s (although I recognize that cold cuts are not the same as chicken/steak that needs to be cooked which could pose an issue). The rule there is clearly written to deal with the health & safety and business type issues and shouldn’t really care whether your carb is a slice of bread or a tortilla. It was probably dumb to ever write a rule that specified sandwiches, but the judge seems to be making a reasonable call based on the spirit of the law.
